In a California workers’ compensation case, a final order is a written decision issued by a workers’ compensation judge that resolves one or more disputed issues. It may determine entitlement to benefits, approve a settlement, award permanent disability, or decide other contested matters.

After a judge issues a decision, the parties have a limited period to challenge it. In most cases, a party has 20 days from the date the decision is served to file a Petition for Reconsideration. If a party outside California is served by mail, additional time may apply.
If no Petition for Reconsideration is filed within the required timeframe, the order generally becomes final and binding.
What Is a Petition for Reconsideration?
A Petition for Reconsideration is a formal request asking the Workers’ Compensation Appeals Board to review the judge’s decision. This may be filed if a party believes:
- The judge made a legal error
- The evidence does not support the findings
- The decision is not consistent with California workers’ compensation law
The Appeals Board may deny the petition, amend the decision, or send the case back to the judge for further proceedings.
What Happens If No Appeal Is Filed?
If no Petition for Reconsideration is filed within the deadline, the final order takes effect. Depending on the type of order, this may mean:
- Permanent disability payments begin or continue
- A settlement is approved and payment must be issued
- Medical treatment is authorized or denied
- The case is formally closed
Insurance carriers are required to comply with the terms of the order. Failure to do so may result in penalties.
What If the Other Side Appeals?
If the defendant files a Petition for Reconsideration, the case is temporarily paused while the Appeals Board reviews the matter. During this time, some benefits may continue, depending on the nature of the dispute.
It is important to respond properly to any appeal. Missing deadlines or failing to file an answer can affect the outcome.

If the insurance company does not comply with a final order, you may be able to:
- File for penalties and interest
- Request enforcement through the Workers’ Compensation Appeals Board
